tREES & dEVELOPMENT
Newport News is dedicated to protecting and preserving its city‑owned trees. The city follows clear standards to ensure trees are properly cared for and safeguarded during development and construction. Before any construction work that could impact trees, developers must obtain the appropriate permits, including an approved site plan and a land‑disturbing permit. These requirements help prevent unnecessary tree removal, promote healthy tree canopy across the city, and ensure that protective measures are in place during construction. In addition, certain specially designated trees receive extra protection and cannot be removed or significantly pruned without city approval. Together, these policies reflect Newport News’ strong commitment to maintaining a healthy and sustainable urban forest.
Tree Regulations and Ordinances:
Chapter 33.02– Site Regulations (Tree Replacement Requirements)
This ordinance sets minimum tree canopy coverage for development sites—20% for low-density residential and 10% for higher-density or commercial zones. It requires a land-disturbing permit and site plan before removing trees, and allows credit for preserved trees meeting size standards. Violations are Class 1 misdemeanors per tree removed.
Chapter 44, Article II, § 44‑90 – Heritage & Protected Trees
This ordinance empowers the Tree Commission to designate “heritage” or “specimen” trees after a public hearing. Once designated, these trees cannot be removed, heavily pruned, or damaged without a permit. Violations carry civil penalties up to $2,500 per tree under state law.
Tree preservation during construction:
Chapter 33.02 – Site Regulations
This is the primary construction‑related tree preservation ordinance. It requires a land‑disturbing permit and approved site plan before trees can be cut, removed, or damaged in a way that alters existing land contours. This chapter also governs canopy requirements and tree protection measures during development.
